Prosecutors intend to seek the death penalty if an Idaho white supremacist gang member is convicted of killing a man while he was on the run after shooting officers in a plot to help a fellow gang member escape from prison.

Prosecutors plan to seek the death penalty against one of the men involved in the ambush at a Saint Alphonsus hospital in Boise earlier this year if he’s found guilty of the first-degree murder of a North Idaho man, according to a news release from the Nez Perce County Prosecutor’s Office and online court records.

Nez Perce County prosecutors intend to seek the death penalty for Nicholas Umphenour, the man who helped coordinate an Idaho prison escape and hospital ambush, for the killing of 83-year-old Juliaetta resident James Mauney.
